1. Legal Information
1.1 The Hush Application and services are edited, operated, and provided by Blyynd, a simplified joint-stock company registered with the Strasbourg Trade and Companies Register (67000) under number 912 765 948, with registered office at 13A rue La Fontaine, 67380 Lingolsheim.
1.2 The Application is hosted by Google Cloud France SARL, located at 8 rue de Londres, 75009 Paris, France.
2. Subject of These General Terms of Service and Use
2.1 These General Terms of Service and Use define conditions for virtual matchmaking Services availability to Users on the Hush Application, including online private correspondence following Account creation and, for certain Services, prior Subscription.
2.2 Application and Services access is free (except for identified Services) and exclusively reserved for adults and legally capable individuals. Minors must not access Services. By using the Application/Services, Users declare they are of legal age.
3. Complaints and Support
For information, inquiries, technical complaints, or Service-related matters, Users may submit requests via:

4. Definitions
- Subscription: Periodic automatically-renewed contract for identical duration enabling access to Paid Services
- Application: Hush application software downloadable from App Store or Google Play Store on a Terminal
- Hush: Company identified in Article 1.1
- C.G.S.: These General Terms of Service and Use
- Account: Personal space created by User, accessible with Identification Elements
- Content: Any kind of content (textual, visual, photographic, chat rooms, etc.) provided/disseminated by User in Application
- Personal Data: User's personal data collected/processed by Hush during Application use, Account creation/management, and Service provision
- Identification Elements: Login credentials and Apple or Google password
- Privacy Policy: Policy concerning Users' Personal Data processing conditions
- Profile: User profile accessible to other Users, composed of User-provided information
- Moderation Rules: Conditions in Appendix 1, modifiable anytime, requiring User compliance
- Services: User connection service for private electronic correspondence exchange and Hush features described in Article 7, including Paid Services
- Paid Services: Additional Services accessed for limited duration/number by immediate payment, renewable as Subscription
- Terminal: Hardware equipment (tablet, smartphone) using iOS 14+ or Android 5+
- User: Any adult natural person accessing Application, for personal use only
5. Scope of Application, Acceptance, and Modification
5.1 C.G.S. define conditions for User Application access, Account creation, and Service benefits.
5.2 C.G.S. conform to and are subject to App Store Rules and Google Play Rules.
5.3 Any Application/Services use automatically applies these C.G.S.
5.4 C.G.S. modifications: applicable versions are those in effect at Account creation date, then at Application access date following modifications. Users must regularly review C.G.S.
6. Age Verification — Protection of Minors' Privacy
Application access is exclusively reserved for adults and legally competent persons. Minors are prohibited.
Mandatory age verification during registration: Users must take a selfie, analyzed by an AI-based age estimation system provided by Yoti.
- Under 16: Access denied, account cannot be created
- 16–18: Must complete verification with official photo ID (national ID, passport, driver's license)
- 18+: Access authorized without further verification
In case of doubt or anomaly detection, Hush reserves the right to request additional documents or refuse access.
7. Account and Profile Creation
7.1 Registration
7.1.1 Terminal and all telecommunication costs are User responsibility.
7.1.2 By completing registration, Users declare they have capacity and that provided information is accurate, up-to-date, and complete.
7.1.3 Users undertake to provide an effective, valid phone number of which they are exclusive owner.
7.1.4 Users must promptly update Personal Data (email, phone) upon modification.
7.1.5 Hush reserves right to verify Personal Data and suspend/terminate Account access if Users don't comply with registration terms.
7.1.6 Hush holds no liability for errors, omissions, or inaccuracies in User-communicated Personal Data.
7.1.7 Following two (2) years of total inactivity, Hush may deactivate Account access.
7.1.8 Upon User death, with heirs' supporting documents, Profile deactivates and Content/Personal Data are processed per Privacy Policy.
7.2 Identification Elements
7.2.1 Account creation requires login using Apple or Google identification elements.
7.2.2 Identification elements are strictly personal; Users keep them confidential.
7.2.3 Users solely authorized to access/use Services with their identification elements. Upon loss, theft, or fraud, Users inform Hush immediately.
7.2.4 If legitimate security violation reasons exist, Hush may temporarily suspend User Account access.
8. Description of Services
8.1 Free Services
- Create Profile with visibility to other Users
- View other Users' Profiles based on filtering criteria
- Manage Profile, modify information
- Store Content, particularly photographs
- Log out and unsubscribe from Google or Apple account
- Contact support service
8.2 Paid Services
- Receive/send Content
- Manage conversations (delete, mark unread, etc.)
- Report and block Profiles
- Receive "warning" alerts for dangerous keywords/unwanted photos (if option selected)
8.1.3 Users are free to delete Account and Profile at any time.
8.1.4 For permanent Account deletion, Users go to Settings and click "Delete my account."
CAUTION: Account deletion is permanent and leads to Profile, photos, and exchanged messages erasure per Privacy Policy; new registration required for Service access.
NOTE: Account termination doesn't terminate Subscription, which remains active until expiration.
9. Financial Conditions and Payment Security
9.1 Financial Conditions
9.1.1 Paid Services prices displayed in euros, including all taxes (VAT, applicable taxes).
9.1.2 Prices exclude telecommunications and internet connection costs, which are User responsibility.
9.1.3 Hush reserves right to modify prices anytime.
9.1.4 Price modifications effective upon Subscription renewal; Users notified before renewal.
9.2 Transaction Security
9.2.1 Subscription payment via Google or Apple account is subject to their respective general terms and conditions.
10. Duration of Paid Services
Access to Paid Services is provided for indicated duration, automatically and tacitly renewable for identical duration as Subscription.
10.1 Subscription
10.1.1 Users select desired Subscription package and provide payment information.
10.1.2 Hush–User communication exclusive mode is email.
10.1.3 Users inform Hush of email address changes. Subscription exclusively for personal purposes.
10.1.4 User non-compliance may result in Hush refusing Subscription/Service access until regularization.
10.2 Automatic Renewal
10.2.1 Upon Subscription expiration, automatic renewal for identical duration occurs unless User terminates no later than twenty-four (24) hours before current period expiration via Google/Apple platforms.
10.2.2 Per Article L.215-1 Consumer Code:
"For specified-period services with automatic renewal, professional providers inform consumers in writing, no earlier than three months, no later than one month before renewal rejection deadline, of non-renewal possibility. If information not provided, consumers may terminate free of charge anytime from renewal date."
11. User's Right of Withdrawal
11.1 Users acknowledge receiving all Services information before subscribing.
11.2 Per Article L.221-18 Consumer Code, Users have withdrawal right and may withdraw from Paid Service without reason within fourteen (14) calendar days from Subscription confirmation.
11.3 Users cannot withdraw if already started using Paid Service, per Article L.221-28-1° Consumer Code.
11.4 Since Users purchase via Apple/Google ID, cancellations/refunds are handled by Apple/Google per their terms.
12. Engagement and Obligations of Users
12.1 User Obligations
12.1.1 User anonymity is an important Application/Services usage condition — no contact details field on Profile and non-communication of identity to other Users.
12.1.2 Each User refrains from requesting any User's full real identity beyond first name.
12.1.3 Users agree not to:
- Disrupt Hush/Application/Services proper functioning
- Provide false/incorrect Personal Data or create Profile under another's name
- Create multiple Accounts
- Use Profile/Services for non-personal, illegal, or commercial purposes
- Disclose login credentials to third parties
- Violate Moderation Rules
- Exploit Hush intellectual property without prior written authorization
12.1.5 Upon obligation breach, Hush may suspend/delete Account without compensation. Hush notifies User by email.
12.2 Special Content Provisions
When Users send content to other Users, contents remain accessible for a maximum of twenty-four (24) hours, after which they permanently delete, except for moderation/dispute resolution purposes.
13. Suspension and Deletion of User Account
13.1 Hush reserves right removing Contents massively sent by Users to preserve normal service quality.
13.2 Hush may suspend visibility of Users using Services in an automated manner. Automated use presumption exists when Users post Content at non-human frequencies.
13.3 Hush reserves right temporarily/permanently withdrawing Subscription access from Users non-complying with T&C, without refund.
13.4 Upon User non-payment of Subscription, Hush promptly suspends all service access.
13.5 Subscription end doesn't automatically result in Account deletion.
14. Advertisement
Hush reserves the right to display advertising/promotional messages on the Application.
15. Access and Availability of Services
15.1 Only Users indicating identical/compatible criteria display in Application, without Hush guaranteeing matching-criteria presence and/or interaction availability.
15.2 Hush makes best efforts ensuring 24/7 Services availability. Application/Services access may interrupt anytime, especially for beyond-Hush-control reasons.
15.3 Hush reserves right interrupting Application/Services access for maintenance/improvement work.
15.4 In emergency, Hush reserves right partially/totally suspending Services access for reasonable duration.
15.5 Service interruptions provide no User compensation.
15.6 Hush holds no responsibility for third-party-website content that hypertext links redirect to.
16. Responsibility
16.1 Contents Broadcasted by the User
16.1.1 Users solely responsible for Application/Services use and all provided/broadcasted Content.
16.1.2 Hush doesn't exercise prior Content control. Hush intervenes only upon User-reported abuse via support@hush-app.com.
16.1.4 Hush has implemented automatic AI-only moderation (no human expertise) to evaluate Content. Since automatic moderation commits no effectiveness guarantee, Hush liability cannot engage if moderation fails or incorrectly flags content.
16.2 Limitation of Liability
16.2.1 Users solely responsible for Services use. Hush cannot be held responsible in User-initiated proceedings regarding non-compliant Service use.
16.2.2 Users acknowledge/declare legal age in their country of residence. In cases of false age declaration, Hush liability cannot engage.
16.2.6 In any event, Hush shall not be liable for:
- Services unavailability due to infrastructure failure or internet-network-connectivity loss
- Non-compliant Service use or Terminal/internet connection malfunctions
- Indirect damages such as privacy-rights violations, loss-of-profits, or data loss
17. Intellectual Property
17.1 Hush holds/licenses intellectual property rights in Application general structure and content (texts, slogans, graphics, images, videos, photos, programs), excluding User Content. Any reproduction or exploitation without express prior authorization is prohibited.
17.2 Hush trademarks, logos, trade names, and domain names constitute distinctive signs not usable without express owner prior authorization.
17.3 Services access entails no intellectual property rights assignment to Users. Services access exclusively limited to Users' private/personal use.
18. Data Protection
18.1 Users acknowledge that providing Personal Data on Application accepts such data may be disclosed/accessed by other Users per Profile-determined settings and various Services purposes.
18.2 For Users' Personal Data collection/processing policy, Users consult the Privacy Policy.
18.3 Collected/used data per these T&C comply with Google/Apple privacy-policy rules per User's Terminal.
19. Miscellaneous
19.1 Force Majeure
Hush holds no liability if obligation performance is prevented/delayed due to French Civil Code Article 1218-defined force majeure event.
19.2 Insurance
Hush is insured by Beazley France cyber insurance policy, 1 rue Saint Georges, 75009 Paris.
19.3 Correspondence — Evidence
Unless otherwise provided, Hush-User correspondence exclusively conducts via email and Application-within correspondence.
19.4 Entirety of the T&C
These T&C represent Hush and User entire obligations.
19.5 Partial Invalidity
If one/more T&C provisions are null or declared invalid, remaining provisions remain full force/effect.
20. Applicable Law — Dispute Resolution
20.1 These T&C shall execute/interpret per French law.
20.2 Disputes regarding T&C: Users contact Hush first, attempting amicable solution. Any claim against Hush must be in writing.
20.3 Absent amicable settlement, Users may resort to conventional mediation per Consumer Code Articles L.611-1 et seq., or use the EU online dispute-resolution platform.
At Hush, commitment to all-users safety, especially children, exists.
The app is strictly intended for 18+ adults. Any child sexual abuse material (CSAM), child exploitation, or minors endangerment is strictly prohibited and results in immediate account termination and appropriate authorities reporting.
Moderation team actively reviews reported content and cooperates with law enforcement.

Moderation Rules
Article 1: User Commitments
Users undertake to comply with T&C and not to:
- Use Application/Services for illegal purposes: pimping, racial-hatred incitement, crimes-against-humanity denial, defamation/insults, computer hacking, or human-dignity-harmful content dissemination
- Publish hatred/violence-inciting Content, threatening, pedophilic, or unwanted violence-containing content
- Without recipient-User prior written agreement, distribute pornographic/nude Content
- Publish, transmit, or distribute any Content involving minors in abuse, sexual exploitation, or endangerment situations
- Distribute financial-compensation sexual-solicitation content
- Send commercial communications or conduct pyramid-style activities through Services
- Upload viruses/malicious code to Application
- Intimidate/harass other Users or obtain Users' contact details/identity
Article 2: Automatic Moderation
Hush has implemented automatic moderation relying solely on artificial intelligence (no human expertise) to evaluate User-distributed Content. The program analyzes potentially harmful images/messages and blocks:
- Content including extremist signs (swastikas, other extremist signs)
- Content featuring children
- Media with added text
- Male genitalia if Safe Lock is activated
When a media is automatically blocked, an information popup appears on the sender's screen indicating the rejected media type.
Article 3: Sanctions
Users can block another User at any time. Blocking results in the blocked User never again appearing in profile proposals to the blocking User.
Yellow Flag — "Abusive behavior"
- 1/day: OK · 2/day: warning + popup · 3+/day: if confirmed → 48H freeze
- User repetition: next confirmed → 1-week freeze
Orange Flag — "Not the claimed person"
- 1/day: OK · 2/day: warning + popup · 3+/day: if confirmed → ID document request + selfie
Red Flag — "Sexual services"
- 1/day: warning · 2/day: if confirmed → account freeze + banishment
Dark Flag — Extremist/child content
5-year-lasting warning. 2 Dark Flags: formal warning. 3 Dark Flags: account freeze. Banishment results in Subscription termination and Account deletion.
White Flag — "Others"
2/day: Content analysis, possible requalification. Abusive reports may result in account freeze.
Article 4: Reporting Content Related to Minors
Application provides Users with an integrated mechanism for reporting suspicious, inappropriate, or illegal content/behavior, particularly relating to child safety.
Upon Hush awareness of content involving minors' sexual abuse, such content is deleted without delay. Hush undertakes to report to competent regional authorities per French law (via pointdecontact.net or PHAROS).
